Home Health: License required

ORS 443.019 “(2)In lieu of an on-site inspection, the authority may accept a certification or accreditation from a federal agency or an accrediting body approved by the authority that the state licensing standards have been met, if:

(a)The certification or accreditation is recognized by the authority as addressing the standards and conditions of participation requirements of the Centers for Medicare and Medicaid Services and any additional standards set by the authority;

(b)The agency or registry notifies the authority to participate in any exit interview conducted by the federal agency or accrediting body; and

(c)The agency or registry provides copies of all documentation concerning the certification or accreditation requested by the authority.”

Hospice: License required

For license renewal: “Hospice – O.R.S. § 443.860 “”(b) May accept certification by a federal agency or accreditation by an accrediting organization approved by the department as evidence of compliance with the requirements for licensure adopted under paragraph (a) of this subsection if:

(A) The certification or accreditation meets standards and conditions established for hospice programs by the Centers for Medicare and Medicaid Services;

(B) The hospice program invites the department to participate in any exit interview conducted by the agency or organization; and

(C) The hospice program provides the department with copies of all documentation requested by the department concerning the certification or accreditation.”

License Renewal

For license renewal: “V.T.C.A., Health & Safety Code § 142.006 – “”(a) The department shall issue a home and community support services agency license to provide home health, hospice, or personal assistance services for each place of business to an applicant if:

(c) The department may find that a home and community support services agency has satisfied the requirements for licensing if the agency is accredited by an accreditation organization, such as the Joint Commission on Accreditation of Healthcare Organizations or the Community Health Accreditation Program, and the department finds that the accreditation organization has standards that meet or exceed the requirements for licensing under this chapter. A license fee is required of the home and community support services agency at the time of a license application.”
40 TX ADC § 97.503 “Except for the investigation of complaints, an agency is exempt from additional surveys by DADS (HHSC) if the agency maintains accreditation status for the applicable services from JCAHO or CHAP.
“40 TX ADC § 97.521 (c) An agency must submit a written request for an initial survey to the designated survey office no later than six months after the effective date of its initial license, unless an agency is exempt as described in subsection (f) of this section. The written request must include:
- (1) the date of admission of the first client; and
- (2) the name of the client.
(f) An initial survey is not required if an agency receives notice of accreditation from CHAP or JCAHO after the issuance of the initial license.”
“V.T.C.A., Health & Safety Code § 142.009 “”(h) Except for the investigation of complaints, a home and community support services agency licensed by the department under this chapter is not subject to additional surveys relating to home health, hospice, or personal assistance services while the agency maintains accreditation for the applicable service from the Joint Commission for Accreditation of Healthcare Organizations, the Community Health Accreditation Program, or other accreditation organizations that meet or exceed the regulations adopted under this chapter. Each provider must submit to the department documentation from the accrediting body indicating that the provider is accredited when the provider is applying for the initial license and annually when the license is renewed.
“TAC RULE §558.503 “Except for the investigation of complaints, an agency is exempt from additional surveys by DADS (HHSC) if the agency maintains accreditation status for the applicable services from JCAHO or CHAP.”

NOTE: 9/2021 – Palliative Care (PC) supportive services must be associated with home health; hospices must have a home health license in order to provide PC services.
